This Privacy Policy (this “Policy”) applies to the 360 Regenerative mobile site, website, app, services, platforms and tools (collectively, our “Site”) which are owned and operated by 360 Regenerative Corp.. and/or its subsidiaries and affiliates (collectively, “360 Regenerative” “us” “our” or “we”). Other sites connected directly or indirectly with our Site, e.g., by hyperlinks, do not fall within the scope of this Policy, whether or not they are operated by 360 Regenerative, an affiliated group company or partner. This Policy governs the collection, processing and use of your personal data and the use and disclosure of your protected health information, when you visit and/or interact with our Site and explains our practices with respect to the placement of cookies, including the types of cookies we use and how you can manage them.

  1. Collection, Processing and Use of Your Personal Data

1.1 Anonymous Usage of our Site

You are welcome to visit certain areas of our Site while remaining anonymous and without revealing any of your personal data by using one of the opt-out mechanisms described herein.

However, when you first visit our Site we will display a cookie banner informing you how we will be placing cookies on your device and tracking your Site usage behavior. This helps us to better understand how our customers use our Site and to improve our Site offering and services, which includes providing you with a more personalized Site experience and targeted offers. In case you have registered on our Site or otherwise provided your consent on our Site to receive marketing communications (see Section 2 below), we will use such Site usage information also to provide you with more personalized communications reflecting your specific interests and preferences. 1.2 Site Consent and Registration

In using our Site or by registering on our Site, we may ask for your consent to receive marketing communications from us. By providing your consent, you agree to receive marketing communications from 360 Regenerative and other third parties and you agree to us sharing your personal data with third parties for marketing purposes. As part of your consent, we may personalize the content of these marketing communications according to your needs and interests based on other information we receive and store from you, such as your account information, order history, or other information revealed by you (including, for instance, data from your usage of our App or from your participation in surveys). We will also use information about your Site usage to provide you with personalized communications which reflect your specific interests and preferences.

By consenting to marketing communications on our Site, you further consent that your receipt of communications from 360 Regenerative, and your responses may be tracked by 360 Regenerative using an analytics tool provided by our third party service providers. This tool also collects information about email-forwarding, undeliverable emails and unsubscribes.

Our service providers will process your information as our data processor only on our behalf and in accordance with our instructions to help us evaluate the usage of our Site and email communications, to personalize the communications to you, to compile reports on activity and to provide other statistical and analytical services relating to the usage of our Site and email communications.

While these service providers may be located in countries which may not provide for the same level of data protection as considered adequate in the European Union (“EU”) or even the United States of America (“USA”), we have taken the necessary measures to ensure your personal data is appropriately protected if being transferred outside of those regions.

You can unsubscribe from our Site at any time, and withdraw your consent with effect for the future, by clicking the “unsubscribe” link at the bottom of the newsletter emails you received or on our Site within the account profile.

  1. Why we collect and process personal data

We collect, process and use your information for the purposes described in this Policy, for any/all of the following legal reasons:

  • Performing the Services: We collect and process your Personal data to provide you with the Services; to maintain and improve our Services; to develop new services and features for our users; and to personalize the Services in order for you to get a better user experience. For example, we may send you offers and products which we think will be more relevant to your taste, based on your browsing habits across our Site.
  • Legitimate interests: We process your information for our legitimate interests while applying appropriate safeguards that protect your privacy.   • Advertising: To the extent we’re permitted to do so under applicable law, to display or send to you marketing and advertising material and general and personalized content and advertisement via our Site, email, postal mail, telephone, mobile devices and/or when you visit other sites, and to track and analyze the effectiveness and relevance of such material.
  • With your consent: We ask for your agreement to process your information for specific purposes and you have the right to withdraw your consent at any time in the manner described in this Policy. For example, we ask for your consent to send you our marketing offers and communications. From time to time, and subject to applicable laws and regulations, we may obtain your consent by offering you incentives, financial or otherwise, such as discounts and/or credits on future purchases on the Website. Even after providing you with such incentives, you may still withdraw your consent at any time.

We may also access and use your information for any of the following internal purposes:

  • To provide and improve our Site and its various functions and features and to manage our business;
  • To send you updates, notices, notifications, announcements, and additional information related to our Site;

2.1 Surveys and Contests

360 Regenerative may conduct surveys and contests on our Site. Unless indicated otherwise, 360 Regenerative will collect, process and use your personal data revealed by you for purposes of participating in these surveys or contests only as necessary to carry out the respective survey or contest and to provide you with personalized marketing communications. We will inform you prior to your participation about what information we will collect and how we intend to use the information collected.

Our survey and contest forms are often generated by using third party service providers. We have appropriate agreements in place to make sure that our service providers will collect and process your information only on our behalf and in accordance with our instructions.

2.2 Disclosure of your Personal Data

360 Regenerative is operating our Site as a data controller. In addition, 360 Regenerative may use external service providers which are authorized to provide services on its behalf and in accordance with its instructions. These entities may have access to your personal data but only to the extent necessary to enable your use of our Site, provide related goods or services, handle your requests or inquiries or provide marketing communications as described in this Policy. For instance, 360 Regenerative may use service providers to host our Site, store your personal data, send you marketing communications or analyze the information collected as explained in Section 2. These service providers may not disclose your personal data to any unauthorized third parties or use your personal data for any purposes other than as instructed. Other than as indicated above, we will not provide your personal data to any third party without your prior consent, unless we are compelled by law to do so.

2.3 To whom we share Personal Data

We may share your personal data with third parties (or otherwise allow them access to it) only in the following manners and circumstances:

  • Third Party Service Providers: We partner with a number of selected service providers, including without limitation our security, data analytics, business, legal and financial advisors, and others (collectively, “Third Party Service Providers”). Any disclosure or access to personal data is strictly subject to the Third Party Service Provider’s undertaking of confidentiality and appropriate safeguards obligations. Our Third Party Service Providers may be divided into two types of third parties:

(i) third parties providing us with services who act as our processors and may only process your personal data according to our instructions (which are made in accordance with the terms hereof). We remain responsible for any personal data processing done by such Third Party Service Providers on our behalf not in accordance with the terms hereof, except for events outside of its reasonable control and except for such Third Party Service Providers with whom you have a direct contractual relationship; and

(ii) third parties providing us with services who act as data controllers with respect to some or part of the information they receive from us, i.e. they may determine the purposes and means of the processing of personal data. Optimax shall have no responsibility or liability with respect to such processing by such third parties. Please see our Cookie Policy below for information on how you can opt-out from sharing information with some of our third-party service providers.

By choosing not to opt-out, you agree that any processing of your personal data by such third parties shall be done pursuant to your acceptance and agreement to their terms of use and privacy policies as specified in their relevant properties.

  • Governmental/Law Enforcement Agencies and Legal Requests or Duties: We may disclose or otherwise allow access to personal data pursuant to a legal requirement or request, such as a subpoena, search warrant or court order, or in compliance with applicable laws and regulations. Such disclosure or access may occur with or without notice to you, if we have a good faith belief that we are legally required to do so, or that disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing.
  • Protecting Rights and Safety: We may share your personal data with others, with or without notice to you, if we believe in good faith that this will help protect the rights, property or personal safety of our Company, of any of our users, or any members of the general public.
  • Our Affiliated Companies: We may share personal data internally within our affiliates for the purposes described in this Policy. In addition, should we or any of our affiliates undergo any change in control, including by means of merger, acquisition or purchase of substantially all of our assets, your personal data may be shared with the parties involved in such event. If we believe that such change in control might materially affect your personal data then stored with us, we will notify you of this event and the choices you may have via e-mail and/or prominent notice on our Site.

2.4 Storage of your Personal Data and Data Security

Your data will be stored on servers belonging to third party cloud service providers that are located in the EU and the USA. We will treat your personal data as confidential at all times, and we have implemented appropriate technical and organizational security measures to protect your personal data against unauthorized disclosure or access, alteration, misuse, accidental or unlawful destruction or loss.

2.5 Mobile Marketing

By opting-in to receive text messages from us or by sending us an initial text message, you agree to receive recurring text messages (i.e., SMS and/or MMS messages) from 360 Regenerative, some of which may be considered marketing and may be delivered by us using auto-dialer systems/technologies. You also represent that you are the owner or authorized user of the mobile device that you used to subscribe for our mobile communications and that you are authorized to approve the applicable charges and rates resulting from such SMS and/or MMS messages. Message and data rates may apply. You (and not 360 Regenerative) will be responsible for all messaging and data charges that may apply. Standard messaging rates apply to your entry or submission message to any 360 Regenerative text message service, our confirmation and all subsequent text message correspondence. Please contact your wireless carrier for information about your messaging and data plans. Your consent to receive text messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. Message frequency may vary.

Data obtained from you in connection with our mobile marketing programs may include your cell phone number, your carrier’s name and the date/time/content of any text messages that you send us. We reserve the right to use this data in the same manner and for the same purpose(s) as other data that we may collect in accordance with this Policy, including without limitation, in order to provide the services you request of us, and to otherwise operate, develop and improve the service.

You can opt-out of receiving text messages from us at any time by texting “STOP” from the mobile device receiving the messages. If you choose to opt-out you will be unsubscribed from the text program. You will receive one SMS that confirms you have successfully opted-out. After that you will receive no further messages for this system unless/until you opt-in again. For additional help, you may always contact us by sending an email to support@360regenerative.com. For HELP, text “HELP” from the mobile device receiving the messages.

Please know that, even if you opted out of receiving text messages from us, we may still contact you for transactional or informational purposes. Some examples are contacts for customer service, product information, service or reminder notices. We may also need to contact you with questions or information regarding your order. Moreover, we reserve the right, at all times, to disclose any mobile messaging data you share with us as necessary to satisfy any law, regulation or governmental request, to avoid liability and/or to protect our rights or property.

2.6 PHI

Our Site is a consumer e-commerce platform, which is not subject to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). However, we take the confidentiality of your health information very seriously, and as such, we voluntarily choose to adopt the strict rules of HIPAA in maintaining the privacy of any Protected Health Information (as such term is defined under the HIPAA) (“PHI”) in respect of any PHI you submit via our Site. In addition to accessing your PHI in connection with the Services we provide via our Site, we also reserve the right to disclose your PHI under the following conditions:

  • Law Enforcement. We may disclose your PHI for law enforcement purposes as required or permitted by law for example, in response to a subpoena or court order, in response to a request from law enforcement, and to report limited information in certain circumstances.
  • As Required by Law. We will disclose your PHI when required to do so by federal, state or local law.
  • Health Oversight Activities. We may disclose your PHI to an oversight agency for activities authorized by law. These oversight activities include audits, investigations, inspections, and credentialing, as necessary for licensure and for the government to monitor the health care system, government programs and compliance with civil rights laws.
  • Judicial and Administrative Proceedings. If you are involved in a lawsuit or a dispute, we may disclose your PHI in response to a court or administrative order. We may also disclose your PHI in response to a subpoena, discovery request, or other lawful process instituted by someone else involved in the dispute, but only if efforts have been made, either by the requesting party or us, to first tell you about the request or to obtain an order protecting the information requested.

As far as your PHI rights are concerned, you may obtain a copy of your PHI, to the extent applicable, that we maintain. You may request a copy of your PHI by sending a request to support@360regenerative.com. You may also request an amendment of the PHI if you feel that the PHI we maintain about you is incomplete or incorrect. To request an amendment, you must send a written request to support@360regenerative.com. You must include a reason that supports your request. If we deny your request for an amendment, we will provide you with a written explanation of why we denied it. In addition, you have a right to be notified following a security incident or breach involving your PHI, and we will notify you in accordance with applicable law.

2.7 Information Security

We take great care in implementing and maintaining the security of our Site. We employ industry standard procedures and policies to ensure the protection of personal data, and to prevent unauthorized use of any such information. Among other means we use Secure Socket Layer (SSL) technology, which creates an encrypted link between our web server and your browser and provides a secured path of communication to ensure the information remains protected and private. Please note however, that regardless of the measures we take and the efforts we make, we cannot and do not guarantee the absolute protection and security of any personal data.

2.8 Your Rights / How to Contact Us

You may have rights pursuant to your local data protection and privacy laws to request that we disclose to you all personal data that we have about you, request the correction, deletion and/or blocking of your personal data, object to the processing of your personal data for legitimate reasons, or request an electronic copy of your personal data for purposes of transmitting it to another company (data portability).

2.9 You may at any time, with effect for the future, withdraw any consent you have given. 3.2 Use of Google Universal Analytics

Our Site uses Google Universal Analytics (“Google Analytics”), a web analytics service provided by Google LLC (“Google”). Google Analytics uses cookies to help us analyze how users use our Site, including the number of visitors to our Site, the sites our visitors have come from, and the pages they visit. This information is used by us to improve our Site offer and services. As a rule, any information generated by the cookie about your use of our Site will be transmitted to and stored by Google on servers in the United States.

Google will use this information as our commissioned data processor to help us evaluate the use of our Site, to compile reports on Site activity and to provide other statistical and analytical services relating to usage of our Site. In any event, 360 Regenerative will never receive this information and cannot revoke the anonymization.

You may prevent the collection of data generated by the cookie about your use of our Site (including your IP address) and opt-out of being tracked by Google Analytics across all Sites by downloading and installing a browser-plugin which is available here.

In this case, an opt-out cookie will be placed on your browser that prevents any further tracking of your use of our Site by Google Analytics. Please remember that you will have to opt-out again if you delete all cookies stored on your device. You will also have to opt-out for each device you use to visit our Site.

3.2 Use of Google Analytics Advertising Features

Depending on the pages you visit on our Site, we may further use certain Google Analytics Display Advertising features, such as demographics & interest reporting and remarketing features.

To enable these features, a third party DoubleClick Cookie will be placed on your device by Google (when you visit certain pages of our Site or Sites from other publishers that have implemented advertising features based on the DoubleClick Cookie).

The DoubleClick Cookie stores information about your use of our Site (and eventually other Sites visited in the Google advertising network), including the sites visited, ad views, page views, user interaction data, browser information, IP-address, a cookie ID, and your search history. Google will not link your name or other personally identifiable information to your DoubleClick cookie without your prior consent. We use Google Analytics to analyze the data stored in the DoubleClick Cookie in order to obtain statistical reports on our user’s demographics (age, gender) and interests. These reports help us to better understand our users and to improve our Site and services.

In addition, we use Google Analytics’ remarketing features to run advertising campaigns (including Google AdWords) to users of our Site. Based on their prior visits to our Site (and their interests expressed during those previous sessions), these users will be delivered relevant targeted advertising when they browse other sites in the Internet within the Google Display Network. We may also use the Google Analytics Advertising features to help us measure the effectiveness of advertising campaigns.

Please further note that the DoubleClick Cookie also enables Google and other third party vendors to serve targeted advertising (based on your prior visits to our Site and/or other sites on the Internet). You can manage your preferences and opt-out of Google’s interest-based ads in your Google Ads Settings. In this case, the unique cookie ID of the DoubleClick-Cookie is overwritten and can’t be associated with a particular browser. 3.3 Other Third-Party Cookies

3.4 YouTube

Our Site also embeds YouTube videos provided by Google. Using Google’s offering requires a connection to be established to Google’s servers in the United States. During this process, certain information is transmitted to Google. For all YouTube videos embedded in our Site we have enabled the privacy-enhanced mode offered by Google. This means that Google stores information about a visitor to our Site only if he or she chooses to play an embedded video. 360 Regenerative does not control the collection, storage and use of any of your information by Google and does not have access to any information collected. You should read Google’s privacy policy carefully before you use any YouTube features.
